Section 5 — Products and Services

Our software products (including Acouso-ROOM) are available by subscription. All use of our software is subject to the Software Licence Agreement, which you must accept before using the software. In the event of any inconsistency between these Terms of Use and the Software Licence Agreement in relation to software use, the Software Licence Agreement prevails.

We reserve the right to limit access to our products or services to any person, geographic region, or jurisdiction at our discretion.

Section 6 — Cloud Infrastructure Usage Limits

Our software products (including Acouso-ROOM) rely on proprietary cloud infrastructure to process acoustic analysis. To maintain performance and availability for all users, we reserve the right to impose limits on cloud processing usage, including limits on project size, frequency of submissions, and total processing volume.

These limits may vary by subscription type and may be updated from time to time. Current limits applicable to your subscription will be communicated via the Software or our website. We reserve the right to introduce, vary, or remove usage limits at any time, including as part of changes to our subscription and pricing structure.

We reserve the right to throttle, restrict, or suspend access to cloud processing services where your usage exceeds applicable limits, threatens the stability or availability of our infrastructure, or is inconsistent with your subscription entitlements. Where practicable, we will provide notice before restricting access.

We are not liable for any loss arising from the enforcement of usage limits in accordance with these Terms. This section is supplementary to, and does not limit, the suspension and enforcement rights set out in the Software Licence Agreement.

Section 7 — Account and Billing Information

You agree to provide accurate, current, and complete information when creating an account or making a purchase. You are responsible for maintaining the accuracy of your account information, including your email address and payment details.

Billing and subscription management is handled through Stripe. For details, refer to our Software Licence Agreement.

Section 8 — Third-Party Tools and Links

Our website may provide access to or links to third-party tools, platforms, or websites (such as Autodesk products). We do not control, endorse, or assume responsibility for any third-party content, products, or services. Your use of third-party tools or websites is at your own risk and subject to the terms of those third parties.

Section 9 — Intellectual Property

All content on this website, including text, graphics, logos, and software, is the property of Acouso Pty Ltd or its licensors and is protected by Australian copyright and intellectual property laws. You must not reproduce, distribute, or create derivative works from any content on this website without our prior written consent.

These Terms of Use are governed by the laws of Queensland, Australia. You submit to the non-exclusive jurisdiction of the courts of Queensland for any dispute arising under or in connection with these Terms.
